    • Abstract:
      The article discusses the views of the late U.S. Supreme Court Justice Antonin Scalia regarding the Eighth Amendment to America's Constitution, terms of imprisonment-related jurisprudence, and the legal rights of criminal defendants. A prohibition against cruel and unusual punishment is addressed, along with proportionality and originalism legal doctrine. U.S. criminal sentencing is assessed, along with constitutional law cases such as Harmelin v. Michigan and District of Columbia v. Heller.
